I think you can book provisionally but you certainly can't give notice until the decree absolute is through as you have to take it with you when you give notice

Yeah what Sonya said, you can book the time and date but you cannot give notice until he is officially divorced. Hubby had lost his decree absolute so had to get another one issued.

You can book your date but not give notice till he's divorced and my registry office we weren't allowed to give notice more than 12 months before the wedding but were allowed to book the date so it was ours n we could start booking other things :)

I believe, and am not saying it's all, only going on experience here, serve notice for a year in advance BUT once you've served notice you have to physically attend the interview within six weeks or so - and they do ask if you are both legally able to marry (i.e. are divorced) - if not, they wouldn't let you book or hold the date (well in Cambridge that was the case).

They have been separated almost 6 years! I just don't understand why they would want to stay married so long after splitting.

I don't think that's right lyn, giving notice includes the interview where they ask if you're legally permitted to marry. Can't give notice until you have the decree absolute

It might be due to the financial side of things I don't think its fair to say their hanging on for some reason! Sometimes you have to wait 5 years before you can get the ball rolling the best advice I can give is you and h2b go and see a solicitor and ask their advice good luck xx

Omg to whoever said alarm bells should be ringing!!! My parents through a relatively amicable divorce and it still cost them thousands of pounds to get that bit of paper!! I am sure he is just being a typical bloke and not getting round to doing what needs to be done. If they have been seperated for six years and is planning to marry again I am sure no alarm bells need ring at all! Xx

I was separated from my 1st Husband for 7 years before I put in for the divorce! There was not a chance that we were ever getting back together, I just didn't have the spare cash to apply for divorce as ex wouldn't go halves with me ( even though he was the reason the marriage ended). Time and money have a lot to do with it but as soon as I got the cash to do it ( redundancy money) it was the best feeling ever to petition the divorce. Even though I was a week away of getting my decree nisi so 7 weeks away of applying for the decree absolute my ex husband decided to end his life! so i ended up a widow instead of a divorcee!

That's terrible Cheryl, but it definitely proves that money is generally behind a delayed divorce :(

If the divorce has not been started yet I would suggest he hurries up. Sometimes they can go on forever, fortunately mine was done and dusted in a few months.

other half's divorce took a year and that was amicable... all this rubbish mallarky going to mediation and all that stuff... meh.. and because other half was the one that instigated the divorce then, theoretically, his wife didn't have to pay owt (though she did for the mediation)

Sarah - I think I got you confused. You can book the appointment at the Registry office to service Notice but you have to attend within 6 weeks to physically go through the interview (this is in Cambridge). When you (or this was in our case) book the appointment to service Notice they ask you if you're legally entitled to marry - if not then they won't book the appointment so it wouldn't be any good to provisionally book a date 6 months or so in advance thinking that the divorce would be finished by then, because they'd want to see you way sooner than that... this was only gone on our experience.
