    hi ladies...i need a bit of advice please.

    as most of you will know me and eddie are trying for a baby. i am over a week late now and tests are coming up negative so i am just putting it down to stress

    i have been offered a new job today that i went to an interview for a few weeks ago. it is a 4k pay rise but bit further to travel and it is a much bigger company and a better job where i can gain more experience so think i should take it.

    i just wanted some advise on getting pregnant in a job job really. can anyone help with employment laws/maternity pay?

    it all depends on the company xx most say that they'll only give you state maternity which is only around 500 to 600 a month. depends what it says in your contract. but as long as you don't know about your pregnancy (if you are) when you go for the job theres not much they can say

    Thanks....At the moment there is a chance i could be pregnant but as i say it could just be stress that i am late.

    i just dont want to take a job, find out im pregnant and then lose my job

    You are entitled to Statutory Maternity Pay (SMP) as long as you started the job at least a week before you became pregnant and you earn over £102 a week before tax in 2011-12. (This is the lower earnings limit - it goes up slightly every April).

    Young Woman In Cafe NewWith Statutory Maternity Pay, you get 90% of your average weekly earnings for the first 6 weeks. After that, you get £128.73 per week for 33 weeks in 2011-12. (If 90% of your average weekly earnings are less than this amount, you'll continue getting 90% of your earnings instead).

    Many employers are more generous than the legal minimum; check your contract, staff handbook or office manual

    If you aren’t entitled to Statutory Maternity Pay, you'll be entitled to Maternity Allowance if:

    you have worked for 26 weeks in the last 66 weeks. (This could be in lots of different chunks or for different employers. It can include self-employed work); and

    you earned more than £30 for 13 of those weeks. (You can choose the weeks when you’ve earned the most, combine wages from different jobs, and it can include overtime, bonuses, or sick pay).

    Maternity Allowance gives you £128.73 each in 2011-2012 or 90% of your average weekly earnings, whichever is less. You may get an additional amount for your husband, civil partner, or someone else who looks after your children, if that person is on a very low income.

    They would not be able to sack you because of being pregnant hun.
    Its just the maternity pay that would alter.
    You would not be entitled to SMP as you have to of worked for the company for 26 weeks by the time you are 15 weeks away from due date.
    You would however be entitled to Maternity Allowance instead

    If you can bear to wait then of course you would be entitled to more maternity pay from the company but they most certainly cant sack you hun x
    If they do you could sue them

    Employment rights

    All pregnant employees are entitled to:

    paid time off for antenatal care
    maternity leave
    maternity pay benefits
    protection against losing your job or being treated unfairly because you’re pregnant

    You must tell your employer that you’re pregnant at least 15 weeks before the start of the week that your baby’s due to be born. However, it’s a good idea to tell them before this, because they have a legal duty to protect your health and safety during your pregnancy.

    You can’t take paid time off for antenatal appointments until you’ve told your employer that you’re pregnant.

    Your employer should review the work that you do and identify any changes needed to protect your health and that of your unborn baby. This will include assessing any risks involved in your job.

    Maternity leave

    As an employee, you’re entitled to up to 52 weeks maternity leave. To qualify, you must tell your employer by the end of the 15th week before your baby’s due:

    that you’re pregnant
    the week your baby’s expected to be born
    the date you intend to start maternity leave

    Provided you tell your employer this, you can take maternity leave regardless of:

    how long you’ve worked for your employer
    how many hours you work
    how much you are paid

    Maternity pay benefits

    Your employer may have their own maternity pay scheme. If they don’t you may be entitled to Statutory Maternity Pay.

    Thanks! this really helps. i will take a look. so as long as you have been in your job a week before you get pregnant you are ok.

    i think i will take this job as it is 4k payrise and it is better prospects just annoying that it is further to travel to and from x

    You have to have been in your job for 26 weeks by the 15th week of pregnancy. i think. I wouldn't know for sure though cos i got made redundant the month i found out i was pregnant.

    My friend was sacked from her job when she first told them she was pregnant, she'd been working there 11 months and was told that she had to be working there a year to get materinity pay, it was a small business tho so it could be different for a larger business, check your contract:) xx

    Future Mrs Wilson. Statutory Maternity Pay is the LEGAL minimum no matter what size of company. Your friend needs to get onto acas 0845474747 and speak to them as she has been unfairly dismissed and will probably be entitled to compensation.
    No matter how small your business you cannot sack someone because they are pregnant and, even if your employees agree to it, you cannot do/pay less than the Statutory minimum of anything.
    Terri Barker - if you are sacked because you are pregnant then you can take the company to a tribunal, which you would most probably win.
    Maternity pay is up to 39 weeks and maternity leave is for up to 52 weeks. Your job must be kept open for you and if, for some reason your job does not exist when you return, you must be offered a comparable job on the same terms as the original one.
    However, because of the timings on SMP it is unlikely that you will have worked long enough to qualify if you are already pregnant so would be entitled to maternity allowance instead. You would still qualify for Statutory Maternity leave though.

    Thank you that really is helpful. i have accepted the job that i was offered and i handed in my notice today.

    i still have not had af this month, nearly 2 weeks late on friday but i have done countless tests and all negative so doubt i am to be honest so hopefully it wont be an issue.
