So, we got our wedding album from the photographer last night. It is gorgeous and from Graphistudio in Italy. The only problem is that is was smaller than we were expecting. I checked our paperwork from 2 years ago when we signed the contract with the photographer as I didnt know if it was just my imagination......
The contract states a 20cmX30cm album was agreed by us in the package (so this would be portrait A4 shape)
We have received a 21cmx21cm album (square)
After checking our booking form too, I realised that there were three options on the form for the album: portait, landscape or square and I have circled 'square'. But no sizes have been stated. But on the contract we agreed the portrait A4 size which is what we wanted and were expecting.
Hubby has rang the photographer and he has said that we have got the equivalent cost of the portrait album in the square format. But I dont understand how the album could be so much smaller in the square format for the same price as the portrait format.
Anyway, he has offered the following options- - We keep the 21x21 square album and he gives us £50 back as goodwill - He orders the correct size album for us IF we pay £150 and give the square album back to him to use at wedding fayres.
Do we take one of the above options OR do we argue that we have not got what we signed for on the contract (despite me circling 'square' on the booking form) ???

I think you are best off keeping it and having him give you back the £50 hun. Although it isn't what you agreed to on the contract, you have admitted that you did circle the square one on the booking form and a lot of people would have said it was your mistake and left it at that, you still have all of the photos you wanted, even if they are a little smaller than you expected so I think he is actually being quite fair with what he is offering xxx

The booking form isnt the contract though and on the contract we agreed the 30x20cm size and its written there and me and the photographer both signed it. So surely he should have said, oh on the booking form (which was only basic details) you circled square is that what you want cus the contract says different and if so this is the size of a square album? and checked with me first?
The next size up in the square albums is 24cm x 24cm so that size seems to be more equivalent to the 30x20cm portrait size. The size we have got is 10cm smaller than what we signed up to..........
I am inclined to not argue it though and take one of the options but just wondered if people thought this was fair or not xx
ooh i dunno, i dunno whether id take the 50 quid or demand the larger one as that was agreed and had the sizes stated, but again you have circled and then signed a contract indictating this is correct, but you've also signed for and agreed on the A4, is it actually written down that A4 is what you have requested as well? That should really have been queried before anything was made up, and that isn't your fault. Id at least demand the 24 x 24 one, you just appear to have gotten the smallest side ofthe A4, which I find extremely rude and poor judgement

the booking form is literally all our contact details and timings of the wedding etc and then right at the bottom it says album: square, portrait, landscape - and I circled square for some reason. BUT The contract states 20x30cm size included and that is what me and the photographer have both signed up to. Then after he'd banked my deposit I got a letter confirming my booking was accepted and in the letter it says there too that we will be getting a 20X30cm album. So I had no reason to think I was getting anything different xx

That's a sticky siutation both a signed booking form and final contract are legally binding. Your photographer should have said something when you booked 2 different sizes.
I would want what I thought I was getting and if you have a confirmation letter that is what the photographer should have provided. I'd argue until I got it.

Id fight it hun, and i wouldnt expect to pay any more as it was confirmed twice in writing that you were getting a 20 x 30 it's obvious the box tickign thing was an error and you really would think they would go with what was actually typed as how would they know what size you want, just from a ticked box??

I never signed the booking form, there wasnt a place to sign it. Also on the booking form it didnt state the different album sizes and costs. The booking form was more about the wedding date and timings. We verbally agreed the album size with the photographer in person after looking at all the various sizes and costs. He then wrote down the size we chosen (20x30) on the contact and we both signed the contract. Then once the cheque had been banked the letter came through confirming the booking and stating what was included in the total cost xx

Exactly velcro, thanks hun :) why has he not advised on the size of a square one and queried if that is what we want as the contract stated a bigger portrait size. He says they both cost the same from the company in italy, but the portrait one is 10cm bigger!

there you go then, get what you paid for - take it to a small claims court if you must. If that's what you signed for that's what you get. Their own tough look they didnt think to query the size. I might be more agreeable if they ave you 30 x 30 but the cheeky bleeders gave you the smallest they could give you and it WASN'T what you signed for
You should NOT have to part with any more money. if they have quoted you incorrectly and it's been agreed, they have to give it you at that price even if it means making a loss, it happened once or twice in my previous job, we'd make an error, underquote, but once it's been accepted it's hard cheese and you just have to plough on.
