Ok where to start My EX is a piece of work.....he is violent, doesnt give me maintence for our 3 boys as he quit his job so he didnt have to pay, I moved out of our house last Jan he never paid the mortgage but put it up for sale, when a sale was agreed he had gone bankrupt so it was down to me to sort but when it came to it he refused to sign the paperwork so that is now going to have to be repod. I get bills for stuff I cant pay as Im just about affording to live as Im not working as moved 180 miles away to get away from him (and to be with my new partner) and I just feel that everytime we get straight and hes not in our lives hes there again!! I think the only thing to do is go bankrupt and start over Rant over xx

can you mabye go speak to the citizens advice and the bank to see where u stand and what you can do before u even think of goin down the bankruptcy route x

Thank you both, cant do anything about the house as I cant pay the mortgage, or rent it or anything as he wont agree to anything .........Im so fed up with bills appearing that I cant pay cause hes gone bankrupt all the creditors come to me ...........I spoke to the court today and the guy was really nice said going bankrupt is easy now as it only lasts a yr and then u can start to rebuild your credit. I have nothing so its not like they can take anything from me .

See i have the same problem hun.............the ex left me with all the marital debts (just under 20k) and as it was all in my name as his credit was bad theres nowt i can do about it :-( What ive done is gone to one of those debt consoladation companies and they have been brillant :-) H2b is basically in the same position so his are on there as well, so for a debt of nearly 30k we pay back £100 a month which is a hell of a lot less then what we were paying before and i feel like i can breath again. They pay and deal with all the companies you owe so no more nasty letters through the door saying you owe this or were taking you to court etc etc. If you want their details hun let me know and ill leave it on your wall, just phone them and see what they can do for you you dont have to take it any further.

Before you do anything drastic get some legal advice and the best place for this is the Citizens advice who can put you in touch with the right people. They will explore the best way of dealing with everything which can also include how to go about with sorting the house out etc. Remember that the letters are not worth anything without a court order so don't let their threats worry you too much at this stage. Its only if it gets to the court stage that you need to start to be careful. In the mean time don't let them bully you and get advice before you even bother to speak to them. Also don't admit that the debt is yours (even if it is) at this stage. Once you know your rights and the best way to deal with this you can start to move forward and it won't matter what the ex does then. x x

i would opt for becoming bankrupt as a complete last resort it may well be easy to become bankrupt but its not as simple as u think to bulid up ur credit im not sure why that person said it only lasts a year thats not true u should do a lot more research into that b4 u were ever to go ahead hun x

like my ex but it was him that moved out and left me no way of paying the mortgage so it was repo'd 18 months ago. He pays nothing towards the 3 children we had together. It is so frustrating as he did think it was ok to keep letting the children down too. (I warned him that if he didn't stop I would stop contact as the children were suffering agedat the time 4, 5 and 8. I went bankrupt last Jan because of all the debt he left me with including joint debt I didn't even know about. The bankruptcy itself is a very easy ( I hate to say) thing to do but emotionally it destroyed me and I had a little breakdown. Of course once that is done and dealt with you can pick up and dust yourself off and move on. My Fiance now is so diferent! my children chose to call him Daddy and he is worthy of their love too unlike their loser father. I would recommend you went down the bankruptcy road because then it's one more tie from the vile piece of work you can cut. Feel free to get in touch if you need help or advice xx

Kateh3..........it does only last a year unless a company forces you to go bankrupt, then the official recievers are quite harsh with you. I am an undischarged banrupt now by choice and a friend of mine was forced to bankruptcy, mine was a lot easier x

i went bankrupt my self by choice as my ex (sons dad) after i left him decided to leave me in 120k worth of debt he decided that when i left he would take out loans in our joint account use all my credit cards etc etc oh and didnt pay the morgage... i said to him when i left he could keep the house as long as he paid it... well he didnt anyways long story short, i went bankrupt .. i had to pay 300 quid to go bank rupt was discharged after a year... i took a crummy job that didnt pay much as if you earn over a certain amount they would have took money off me for that year to pay towards the bankrupcy... it takes between 5-7 years to rebuild your credit enough to get a mobile phone contract but it is the best thing i have ever done in my life.. the CAB did mine and because i was a british gas customer they paid the 300 quid fee for me too as they had a scheme at the time. The CAB will offer you advice any help towards the fees of bankrupcy if your entitledGoing to see the judge in her office was very scary but it took 3 mins she signed a bit of paper and said nice to meet you and off i took my bankrupcy papers to the insolvency people... took about 2 hrs in total but it was the best thing i did as i didnt worry about a knock on the door or what the postman would bring and i felt free again if that makes sense... oh dont forget if you go to the CAB remeber to take all your debts with you as. plus if you owe less than dont quote me 10k the court wont let you go bankrupt (may be lower now but when i went bankrupt it was 10k)

I agree with Crocadillo, the debts I found out about was £76k I believe there is no minimum now for bankruptcy. You can include things like council tax and tax credit overpayments now too. Be under no illusion, waiting to see the judge is scarey but it is only a few mins before they stamp your notice and the feeling of freedom is overwhelming!! Make sure the house has been repo'd and you have the outstanding figure from the mortgage. If you have to wait for that then work out your income/expenditure in the mean time and send it to creditors offering a token payment. (mine was £1.00 per creditor) Once you have all the final figures then seriously think about your options. xx

i had and have the same problem with my oldest sons dad he was violent to me, he refuses to pay for my son and quit his job so he didnt have to. he left me £5000 of debt plus 2 contract phones and a car on finance to pay off as he had already gone bankrupt it was all in my name. i went to citizens advice and they helped me write letters to creditors and i paid £1.50 per month to each for 2 years, and as long as you dont miss a payment they normally wipe remaining debt for you. chin up. citizens advice will help and put you in touch with all the right people xx
