I'm so mad right now. We live behind a football field and park and are forever getting balls coming into the garden etc. We went out for a day trip out to come home to find all our fence panel is broken where the gits have decided to climb over and get the ball because we were not in. They do it all the time and I'm sick of it. The council refuse to do anything about it saying its not down to them but they are the ones providing the goal posts behind our house and then not giving us any protection from it. We already have a nine foot fence so there is little more we can do. They just refuse point blank to put nets up.

So far the football club have been waking us up every Sunday morning to get their ball back and during the week we get loads of the kids coming to get the balls. Does anyone know what we can do to stop this from happening (legally) and how to get the council to take action?

Oh Jo, that's awful! Take piccies of the state of your fence/garden. First off these people were trespassing today. Send copies of the pictures to the council and ask what they are going to do about it as it's gone beyond a joke now. Say you want financially compensating for the damage they have caused and see where that gets you hun Hx

The fence is 6 foot. We end up footing the bill all the time because it isn't worth claiming on the insurance. They damage the flower beds, bins, dirty washing etc and if one of them balls hit me it would cause me some serious damage. The last time that we spoke to the council they said they are not legally responsible as it isn't them that is causing the damage and its down to the trespasser and for us to prosecute them. Like we are going to find out who that is?

I've had to call the police before because I've come downstairs to find strange men yes MEN running around the back garden.

you'll be sued if they hurt themselves whilst trespassing on YOUR property? what a joke! if you could set up a video camera or something that would be useful, can give the footage to the police if/when it happens again. i'd also go to the newspapers and kick up a fuss about it xxx

you cant put anything on the fence that an intruder could hurt themselves with so no glass, barbed wire etc etc. I would personally get anti vandal grease/paint for along the top of the fence as it makes it so hard to climb over and marks their clothes. You do need a sign up warning them of though!
TBh I would also invest in a much stronger fence made up of individual planks that are over lapped to increase strength to the maximum height which is above 6ft and not the fence panels as they damage too easily. Other than that it is CCTV cameras on the fence and garden and start prosecuting
    So bloody annoying though!

Actually, from a nit-picky point of view, unfortunately the whole "Trespassers will be prosecuted" thing is a bit of a lie. You can't prosecute simply for trespass.
I'd suggest CCTV, a stronger fence with anti-vandal paint and keeping a full diary of exact times they disturb you, what damage is done etc. and you might be able to get them for criminal damage. Failing that, it would have to be a private civil suit against the individuals or the football club.

Its not just the football club that is the problem though. Its the kids and anyone else that uses the field to play in. I can see their point of view they want their ball back etc and its an inconvenience to them as well as it is to us but the council could turn the posts so they back into the fields not the houses and that would sort it for all of us then. I just hate the way they think they have everyright to come onto private property to get it back. I would never dream of climbing a 6 foot fence to get it back.

The house next door to us has the problems too and they kept climbing over and leaving the gate open so their dogs kept getting let out. They put a padlock on like we have too. They also broke another neighbours fence but again nothing can be done as you have to know who the person is.

only thing you could do to prevent them climbing over to get their balls and damaging the fence is to replace it with a brick/breezeblock wall, and paint anti vandal paint along the top edge of it. Also put a lockable gate on the side entrance (if you have one) to stop them going in that way too.
but keep complaining EVERY time you have this problem and the council will eventually get fed up with all the calls and do something about it.

plus also have trip wires that set off big fog horn noises etc etc

or just do my approcach stick a sign saying traspassers will be shot at... and get an air riffle or something and have fun!!!

The barbed wire thing isn't exactly true... on my street, we are terraced houses separated by alleys that are blocked... all the doors are topped with either razor wire or barbed wire and vandal-proof paint... nobody is stupid enough to try it and as far as I can tell the police don't seem to mind...

I think the CCTV thing is a good idea, it's expensive at first but if anything happens to your house you'll be very glad of it. As will your neighbours, for example when I was younger our car was taken in the night and taken on a joyride... our neighbours across the street had CCTV and because of that we were able to find out what happened and the police were able to use it! You will then have video evidence as well... so if you put up a simple sign saying that you refuse entry on to your premises to retrieve lost footballs, and will return them when you get home etc and have the cctv, you can then take that to the football club and say that if they continue to trespass on your garden you will take your footage to the police and have the pictured players given an injunction preventing them from going within a certain distance of your house. And also that you will be sending them the bill for your broken fence panels and any other work that needs doing to your belongings or garden as a result, and will send on any future ones if they don't respect your property!

Tbh they should bring spare balls so they don't have to do this, I think it's appalling people think they can do what they like!

If barbed wire's not possible you could grow very spiky, nasty plants over the fence to help put people off? Wonder if you could also go to your MP suggesting all they need to do is to put nets on the goalposts or move them round. Also, keep correspondence you have with Council on this x

Surely if you put a warning sign up that lets them know that you have barbed wire there you can't be blamed if they then try and climb over them - its their own daft faults seeing as they've chosen to ignore the warning. :-s

If you are to get a camera put up outside you need to check with the police about the positioning of it as we were going to put one up so that when Pauls bike was outside in a parking space we could keep an eye on it. We were told by a police officer who came to our flat that we wouldnt be able to place it towards the street as it would then record people walking past and that isnt allowed. But in your case I would assume the cameras would only be within the vicinity of your garden.

I will look into that and thanks Spooney. Yes Lisa it is frightening cause it isn't just kids. I've had grown men climbing over the fence and as my mobility isn't good its scary not knowing what they are coming for. The police are going to get sick of all the calls but not as sick as I am with them. They rang the bell today when the ball came over but because I couldn't get to the door they thought no one was in so they could help themselves. After yesterday though I was keeping an eye out as I could see out the bedroom window. Just makes me so mad. I would never dream of going into someone's garden like that. Even more so when they can clearly see the damage someone else has caused from the day before.
