Becci, hope everything works out for you. If they're restructuring they really need to do a reasonable period of consultation before deleting a post and interviewing. Terrible HR practice, consultation is the reasonable thing to do.

Really starting to ramp up in work now - Christmas and the new year up to the new financial year is our busy period and we're starting to get work in with December deadlines now. Also just found out my colleague is on leave from 4th to 15th December... excellent. What did my boss approve that one for?!!
It will be Christmas before you know it, people tend to be prepared in December because they know people go off but at least they have given you time haha! xx

Good luck Sarah. They really can't do anything to you without good grounds. They might not tell you who made the complaint but they know, and if it's shown up to be totally ridiculous maybe they'll come back on the person who made the claims for wasting their time. Is the thing that you're off sick for something that would prevent you being able to do any other work as well? Could evidence from a doctor help? The thing about reading up about disciplinary proceedings could well just be a standard letter that they give to everyone.

They shouldn't interview before final consultation!
Noooooo! STOP!
Interviewing before consultation closes implies consultation is meaningless because they've already made up their minds and not going to take into account staff points etc anyway. Bad bad bad practice.
Grrrd, sorry but that has wound me up! Are you in a union?

At my work they've observed the silence for the last three or four years. Before that it was really difficult, I was often on the issue desk, and although I would be quiet at that time if someone came to the desk I felt that I had to serve them. Now they ring a bell throughout the college at the beginning and end, and an email is sent around the whole college, so we can observe it. If anyone comes to the desk in those two minutes they just have to wait.

I got an email Friday before the letter arrived with this meeting request and I phoned in to talk to the person who emailed me but she decided to email me on Friday at4pm when she finished so I couldn't talk to her. I got the financial director on the phone and He said there isn't much they can do until they talk to me but what can they do when there allegation is ridiculous and not true the whole thing is a joke! I'm looking forward to getting home tonight. The work on the house has finally started, so we've got a carpenter in laying floors. He won't finish today, it's going to take him four or five days, but I'm really looking forward to seeing how far he's got. We've also got a plumber joining him so we will finally have a shower that works, and hopefully the leaky radiator will be fixed as well. They're basically a bit of a cover all company, the guy who runs it is a plumber by trade but they've got other people that have other areas of expertise, as well as some who are more like general labourers. By this time next week the house should have been transformed, and hopefully won't feel like a cross between a house and a building site anymore. Then a week today a removal van is arriving from my parents in law, who are downsizing after Christmas and getting rid of a lot of stuff. We're getting a piano, three piece suite, single bed, large mirror, various bits of smaller furniture, a baby bath (hubby was bathed in it), various pictures, and I can't remember what else, We can finally start getting the place straight next week. I can't wait.

Oh no Becci, if your organisation recognises a TU they should let you know. Is there someone you can ask? Other colleagues might know. They're going about it the wrong way, if they did that to me and my colleagues they'd never get away with it.
Last time I went through a restructuring in our department the senior managers got absolute h311 from us. I pulled apart their consultation paper line by line then made so many valid points along with my colleagues the management just looked a jok. Afterwards a TU rep said to me we don't need the union as we can fight it well ourselves. If you're going to do it to HR professionals though you had better do it properly but they completely messed up. The union rep said she actually felt sorry for management because we showed them up so badly.

Sarah, my advice to you is: 1. See this through, I know it's hard but don't let them win! 2. Ensure they manage your sickness absence appropriately. You say you're off because of the way they treated you, does this mean you're off with work related stress and for something you could, legitimately raise a bullying and harassment grievance about or one for victimisation? 3. If yes to point 2 as soon as the disciplinary process is over raise grievance. Depending on the outcome of that, if you're unsatisfied you take it all the way to the end until you've exhausted all the internal processes available to you. 4. If you're still unhappy and still being treated poorly you can then resign and raise an employment tribunal case against them for bullying harassment victimisation (whichever it is) and also constructive dismissal.

Becci it does sound like looking into a union would be helpful. Union reps. will not be phased by HR, and will not let you be unfairly treated. HR have no right to be annoyed with you because of the crash, you're doing everything that you're entitled to do. Will you at least get a decent redundancy package if you lose out at this point?

I doubt it because they said they're not looking to loose heads they'd find another role possibly in ops for the person who is unsucessful but I don't want to go into ops and I've only been with the company 18 months so don't think I'll be entitled to anything
CommentAuthorElinor Claire
That's a shame. At least after 18 months you wouldn't lose a lot of money by turning down the role. My husband has a colleague who desperately wants to leave, as she works part time and since she had her second child the childcare is costing her more than she earns. However she's been there 11 years so even on a part time salary she will waive goodbye to a very hefty amount of money if she just gives her notice in. Unfortunately on the last review her area wasn't reduced at all, but my husband reckons it won't be long before they reduce numbers again, and surely her team has to be included.

He's, been watching bing bang theory whilst Freddie slept. He is awake now and it's come over all dark and guessing it is raining out there, not heavy, just drizzle,
Cuppa before the kids are back. My son has a football match after school today, he had one yesterday as well but that was unexpected, they thought it was just training. Then tomorrow he has a rugby match. He wants me to go watch it but it's on the other side of the island and it will interrupt with Freddie and his dinner. It does not finish until 6 and then will take me a good 45 mins or so to get back depending on traffic. He understood though as he knows otherwise I would be there.

My mum has carried on buying advent calendars for myself and my brothers. Now though she tends to send us an online one. It takes you to a village and each day you click on the number and something different happens. Sometimes there's a game to play or a puzzle, other times there is something to design and make on the computer. Sometimes you just watch, or there is something to read. It's great fun.

Becci HR should be impartial and neutral, they are there to advise and guide managers yes but they are also there to protect the organisation and minimise risk, that means ensuring management do what they should by legislation, case law and best practice.
HR don't take sides, if they do then they are poor practitioners, they can support management if management is right but ultimately they should be a "critical friend" to stop managers or influence managers to not do the wrong thing which could be extremely costly if they end up in employment tribunal, I'm talking financial and reputational cost.
