Just want to rant a little.

My oh got married after being with someone for about 3 weeks (they ran away to Gretna). He is so embarrassed about it that only a few people know about it. He says she pressured him into it and e was at such a low state he just went along with it. (I know I could just shake them both).

I said we need to do something about this and take the bull by the horns so to speak so this time last year divorce starts being mentioned. She went to one of those Internet divorce companies and said the fees were about £350 so she wanted him to pay for the court fees. This took until new year and I gave the money for the fees which he sent off to her this January. We didn't hear anything for ages and he sent her texts asking what was going on but she always sent grumpy texts back saying it was at the company etc. it got to such a stage that we got a copy of the marriage certificate and were going to put it in ourself (2 years separation). Anyway that seemed to do something and it went ahead. The decree nisi went in21st July which meant she could apply for the absolute from the 1st September. He rang the court on Wednesday to be told she had put the form in too early and it had been sent back. He sent her a text message asking whether it had gone back in and she replied 'no it costs money' we sent one back saying 'are you waiting untl payday.' which is this Friday and got no reply.

Yesterday he sent another text saying that if he has to wait until he can apply they both have to go before a judge to explain why it hadn't been applied for before. She replied 'you pay for it then'.

My oh is fuming. From looking at the court forms it seems that she made it up about using the company and has done it all herself the company sends the absolute on your behalf and they wouldn't have made the mistakes with the form /process.

She clearly had the money earlier to apply for it before but has decided to get him to pay for it.

I think it's worth the money just to get rid of her so we can start looking at our future. We were looking at an October date for our wedding which is now going to have to get postponed! We should have put our application in when we could. It would have been over by now.

I've said I'll happily give the money and pay for the stamp!

    A aargh!

Thanks. You are right he should have started it don't know why they agreed she would do it. We had all the form filled in etc ready to go but my oh has been away a lot with work and his idea of dealing with stress is to bury his head. Mine is to deal with it ASAP.

Hopefully when she gets the cheque it will go in this week and be over with soon! I said let her sign the form and give it to you and I can take it down on my lunch break!

Myslef and my h2b have just gone through a divorce this year , Via a solicitor. I thought my case would have been longer than his but I was officially divorced in April and Darrens came through last month. If your h2b and the person he married didnt live together after wedding or havve not been together for 2 years or more it would be a fairly straight forward case, one of my local solicitors do a set fee for 199 plus court fees .

    Thanks everyone.

My divorce took 9 months but there was child contact etc to sort out. His they were together for 6 weeks in total and have been separated for nearly 3 years.

Hopefully she will send the cheque in tomorrow and it will be soon over!

Im not sure of all your facts, but if he has the copy of the decree nisi, HE can apply for the absolute. As long as 6 weeks and 1 day have passed since the date of the nisi, he just needs to pop along to the court, show the form, pay £40 and the absolute will be granted there and then. Thats what i did anyway!

Hi sukiedoo He can't apply for the absolute for another 3 months as she applied for the divorce. So it's just a waiting game at the moment to see when she puts the cheque in (which she received yesterday).

Thanks Helenw I'm sure it will get sorted soon.
