its good knowing you have the information at your disposal so should it get that far and go to some kind of court their reasons and explanations etc will get thrown out because it isn't written down (in the correct manner and clearly enough) BUT that now gives them a thought for future that they need to update their policy, should they want to stop this from happening again. (Not that you are in the wrong they are!!!!!!!!!!!)

lol i actually told them in one of my previous letters that what they r tryin to say isnt written down like that and they needed to update their handbook and i suggeted they even got a seperate contract for emplyees to sign when they place their orders and this would stop anymore confusion in the futue! When i showed it to Citiens advise they actually laughed at what i wrote and also said its funny cos its so obviously true!

me and my family are in a big battle with a travel company due to the conditions of a villa we rented in america in april, they are offering us compo of less than a weeks rent for problems that lasted in some cases the duration of the holiday. Ive learnt to document EVERYTHING and keep on top, because the travel company has a duty of care to respond within 28days of recipt of letter, the last letter we dated 35days after confirmation of reciept, we're in the process of drafting a letter o ABTA which i must do this weekend!!!
Im my dads daughter and he's very strict on rules and compo etc and fighting your battle. I complain (not at everything0 but if theres something to be said ill say it, i did it in a restaurant the other week and got us a free meal co head office! sorry but 2hours and 4 people and only getting to eat a main course in that time was abismal!
    but they are other stories!

Thats rubbish that its taken then 4 weeks to get back to you and also giving that other ex member of staff more discount. That is shocking. I hope you get this sorted out soon XxX

Thanks clarabella but its actually 4 months its taken them, which is furiously wrong! I was starting to think as they wasn't replying that they had seen their errors and wasn't replying to admit they was in the wrong, no such luck! When I hear back from citizens advise I will be sure to let u all know xx

chin up hun, we're all pretty sure ur right and CAB are obviously thinking ur right too or they would of told u. Trading Stds are pretty useless I contacted them about a washer drier problem I had and even tho I explained the situation washer 12month old paid £400 for it barely used in that time, broke on a friday pm when the service centre closed for weekend etc etc they couldn't do nothing? I mean come on who had £400 a yr to spend on a washer (which constantly breaks - I had 5 engineer call outs before I gave up) and now have a dud washing machine in my kitchen until we can afford to replace it!

if your old employer did the dress discount as part of a "work uniform" discount policy (like they would at most everyday clothes stores) then i would imagine that theres not much you can do? if you have a separate contract (and records of it) then you might stand a chance of getting your deposit back or sticking to the original deal. but i would imagine that the employer sees the discount as a perk of your employment and since you are leaving they are within their rights to claim the rest of the dress costs back and hand over the dress early as you have quit the employment contract you are in with them.

    sorry!

Thanks Katie_lou i was looking for everyones opinions but i signed the same contract as every bride does with a note sayin staff discount it isnt a works uniform discount. They are saying the staff discount is perks of being an emplee and as i am no longer an emplyee then i dont qualify for it but i paid the deposit when i was an employee a month before i even handed in my notice and it doesnt state anywhere this is the procedures if a dress is on order with them and u end up leavin, plus they let another member of staff get her dresses in the right time with more discount, Its unfair that they are doin this to me and no1 else.

Thanks for giving me your opinion tho all input either good or bad is what im lookin for

no worries, i hope tht you're right and you get it sorted!

how big was the deposit? if it were me i'd be trying to get tht back and getting another dress elsewhere... sounds like a whole lot of stress tht you could probably do without?!

    Good luck x

If you have signed a binding contract, then they cannot go back on it. The only thing I would suggest is look at your staff handbook about how your discounts work when hadning in your notice.

Also, did u pay any of the dress by credit card? If so, contact ur bank as they are obliged to help. It doesn't matter how much u paid, as long as the value of the item is more than £100 and less than £30,000.

ive got the staff handbook and all it says is u are entitled to discount nothing about leaving while a dress is on order its just that 1paragraph that they keep twistin the words to.

Yeah i paid £150 on matercard just to be covered so im waitin to hear from CAB to see what i need to do next. Some people do keep tellin me to go elsewhere and just ditch the deposit but money is always tight and it i THE dress for me I've had my heart set on it since it arrived in the shop and i dont want to just leave it behind without giving it everythin ive got to battle it out!

I would phone your bank now and tell them the situation. They will get it all sorted within a week. I had a problem with not getting a camera I ordered online and they took care of everything. I got the money back on my card within a week and didn't have to think anymore about it! They were brilliant and so reassuring.

How you pay and your rights
If you pay for something using a credit agreement, credit card or Visa or Maestro debit card, you may have additional rights if:
there’s a fault with the item or service
the trader has gone out of business
If you paid for something costing between £100 and £30,000 using a credit card or credit agreement, you can make a claim from your finance company.
If you’ve paid using Visa, Mastercard or Maestro, you may be able to claim your money back through their ‘chargeback’ scheme. You will need to contact the card company to make a claim.

The above is from a consumer rights page. I will put the link on your wall.

i would threaten them with court action and show the proof of what u have signed just like any other bride, and the fact that when u set up this contract u were an employee and was for 2 years so u didnt just join a company for a discount and leave. the date shows u set up the credit agreement while u were employed so 2 me they dont have a leg 2 stand on! thats all there is 2 it! go in with full force and no fear and i think if they were a good company they would stop being silly and keep 2 the agreement as word of mouth is very bad 4 business!! good luck x

What they are saying about how much you are expected to pay must be wrong. If any of us put a deposit down on a venue or dress or any other high value item we pay the price advertised at the time of placing the order/booking so this can't be different with your situation and I agree if you have signed a contract that states clearly the price you are required to pay for the dress and that it will be ready 4 weeks before the date required then this needs to be fulfilled. Especially as this happened with another employee. I really hope you get this all resolved soon so its put to bed.
Not sure if they can add extra paragraphs to the employee handbook with things like that without providing new copies of the handbook to all staff as it almost like changing an employees contract without giving them a new copy its just you don't have to sign it xx

If they signed a contract they have to honour it, surely?! They should've thought about different circumstances when writing the contract up, so they could put conditions in it. It is not your fault that they didn't think it through properly. x
