Good evening ladies! Well today we have got hold of the solicitor and we have a formal appointment next Wednesday. So fingers crossed we get the information we need to be able to take the matter further. I've not heard a word from the owner of the shop either so either she thinks we have let it drop, or she thinks I'm mad for not taking the dress. I will keep you all posted with what we get told next week x

Even if it doesnt and you cant do anymore with your original dress, you paid for it so take it and possibly you could try to sell it to even get abit of money back :( main thing is you have a new dress for your beautiful day :D x

Hello all - well here is the latest. Went to see a solicitor today, he reckons we have grounds to fight the owner of the shop so he is writing the owner a letter requesting a refund. Won't get to see the draft letter until next week but it's worth a try. Wedding is a week on Saturday and I'm just so grateful I have an even better dress! X

Really glad solicitor thinks the same as me! The shop really doesn't have a leg to stand on and hopefully as soon as the receive solicitor letter she will realise it's time to give up!
At least you can now enjoy your magical day knowing you have an awesome dress and that hopefully you will receive a full refund!

Update - I doubt very highly she will give us a refund. After emailing her to inform her our solicitor would be writing to her, she emailed me stating she is not liable for my wedding dress after my wedding 24/09 and when will I be collecting it. She has no sense of compassion or understand how to be a good business owner x

To me though yiu ordered a product, made to measure, it didn't fit, therefore you have not got what you paid for, you have told her you are refusing to accept the dress therefore she has broken the contract. Let's hope when she gets the letter from solicitor she will change her mind- don't let this bother you- she is just playing games xx

Agre with the above and she probably thinks you are bluffing. make no further contact now unless through your solicitor. She sounds like an awful woman. How can she not be liable after that date? you've been trying to rectify this for ages, surely her dragging her heels will not see her safe once that date is passed. DO NOT collect that dress and don't contact her further, I would however let your solicitor know what she has said in that final email.
Have you provided him with previous correspondence to her and the dress supplier to prove you have been trying to rectify this? If so I don't see how she can think she can have a leg to stand on. You paid for a service which hasn't been provided.

Hello all - yes a full copy of all correspondence, via email, letter and text message has been provided to the solicitor. We have given a timeline of ecerything so he has all the details, and is away she has given us this deadline, for what purpose we have no idea. I get married on Saturday so whatever happens happens, I have a beautiful dress and by now she must realise we will not be collecting the dress from her. X

Hello all - well I'm now married yay!!! Just wanted to give you an update. We today received a response from the owner of the bridal shop. She still will not admit any liability for for what has happened. She has offered us £500 and also imposed a gagging clause in this!!! She is still advertising the dress and so is still current stock!!! X

To be honest I would accept this offer, your married now and you'll be wanting to focus on this rather than dwell on the past and you dint want it to taint the memory of your day. I would accept it and move on :) glad you got something back!!! x

A gagging order is a legal document that prevents you from mentioning what happened, eg no bad press no bad reviews, pretty much forgetting about what happened

If the the dress plus £500 then I would be tempted to take it. It all depends on what you want to get out of it, do you just want it sorted or do you want to make sure it never happens again?

We initially asked for £1000, as the dress itself is worth £1400 brand new.
In all honesty we find it insulting that she offered us that much. As we paid around £1150 for the dress as it was on offer, and she can go ahead and sell it for at least that agin.
Although our experience has been posted on here, to date we have left no megative comments on FB or her business page, and it's like she is getting away with it.
I feel if she wants us to drop it we should get what we asked for but it's my parents decision as they paid for the dress z

I would ask for he dress as well- it's your dress and £500 as its her that's in the wrong
To me she has to either give you your dress back or a full refund- end off
If she will not offer more than £500 I woukd take the dress- you can probably still get £800 for it so shouldn't lose too much money

I wouldn't accept that, I would want what I paid for it. And I'd tell her she can cram her gagging order up her ar$e. You have every right to leave a negative review. I imagine she is starting to sweat now - especially with her trying to impose that order - she knows you have all the written proof! If she wants you to accept the gagging order then IMO she has to PAY for your silence. i.e. not only do you get what you paid for your dress, but ''hush'' money as well. That's the whole point of a gagging order when the person in question is the one at fault. they essentially pay you to be silent. Quite frankly, I think her offer is insulting.. I wouldn't want the dress, because then you have the hassle of selling it on, and as a private seller you can't guarantee that you will shift it for the price you want.

Edit* just to point out, I wouldn't be interested in chasing for compo, that's not what I am trying to get at. I'd just want the full value paid WITHOUT the dress and I'd let her stew or not on whether I left a review as is our right when we have factual based evidence to prove what you are saying is not slander as is your right. My point being, by trying to impose a gagging order, she should be offering more and basically, I'd just tell her I want the EXACT value paid of the dress and that she can cram her gagging order. That part I would NEVER agree on, If you get what I mean lol
Why should your parents take a financial loss, and she come up smelling of roses knowing you can't bad mouth her - even word of mouth could get you in trouble, that is not worth minus £500 which is what she is offering, regardless of whether she is offering the dress as well. (chances are it will need dry cleaning as well by this point)

I'd agree too, she's taking the micky. I would be prepared to accept a gagging order and full refund, plus assurances that they will look into what went wrong. I'm sure the solicitor can push it further, she won't want to go to small claims court.
