We leave first thing and we are actually all going away together.

I honestly am at my breaking point now. We wanted to respect their wishes as they said they could not be contacted while it was ongoing (I believe to just having the baby and I think there may have been a few problems) but they are stringing us along.

I am left wearing a dress that is dirty and I don't want want because the whole thing has ruined it and I now hate the dress... I am absolutely gutted - well that doesn't even describe how I feel really.

My mum looks she could cry all the time too x

    Bless ya....

I know it's not ideal but take all the details with you and if, if you can call, it may be worth it!!

Get an email together now to TS and send it before you go away, I'd even cc the shop into it if at all possible!! No way would I let this go, holiday or no holiday! At least you've done everything possible, for now!

Try and enjoy your holiday and deal with them full on on your return! Xxx

I'm with Em I would not let this go! They are disgusting! If they were that stressed with the new baby etc they would just give you what you wanted so that they didn't have to deal with it. Something ontoward has gone on here and they know it! When do you get married again? Xx

I honestly think she will contact us tomorrow and tell us again she has no legal responsibility to help us.
I feel so bad that my parents have lost so much money.

I get married 4 weeks this Saturday so they know we literally have very little time to do anything. They also know with us going away that reduces that timeline even more. They really are playing nasty and it's so unfair x

We contacted Citizens advice last week which I believe run side by side. They basically said it was our job to prove they have made an error. It isn't for the business to prove they have done the right thing. All we have is my measurements and that's it so don't think TS will help us x

You need to tell them you are considering legal action and will be contacting trading standards. Are you able to go get a new dress? I know it's not ideal but that will take the pressure off you not having a dress but I would not let this drop with the shop. They ordered you the wrong dress!! That's their responsibility!! If at the beginning they even gave you the off the rack dress for half price but she expected you to pay full price for a dirty worn dress. Hope you have a good hol regardless, you deserve it! Xx

If you can get your hands on the designers dress chart you can prove she should have ordered you the bigger size, as it's standard they go by the biggest measurement which they haven't. Xx

This is covered under consumer rights act

if you purchased a dress that was supposed to be one size but is not, or you paid for a made-to-measure outfit that doesn't follow the correct measurements, you should be able to claim your money back or ask for a replacement dress under the Consumer Rights Act (this superseded the Sale of Goods Act on 1 October 2015).

Under the Consumer Rights Act your dress must be as it was described to you, of satisfactory quality and fit for purpose.

If you order a dress and the material, fit, or shape is not as you had been told it would be then you should be able to reject it and get a refund within a reasonable time.

If you’ve bought your dress from an online retailer you also have additional rights under the Consumer Contracts Regulations.

You can choose to reject the dress any time from the moment you place an order to 14 days from the day you receive it.

I would go quoting this- you have clearly rejected the dress as it does not fit and therefore under the consumer rights act you are entitled to a refund- end off- in their face!

I'm confused, what happened to the one that arrived in June that was loose? That was made for you, and would have been easy to alter. Most dresses need taking in as a lot of brides lose weight, even if they don't intend to. Why did she swap it for a smaller size, and what happened to the larger one? Surely it should be there somewhere. I bought a sample dress as it just so happened that the store was selling their sample of the exact dress that I wanted as the design was being discontinued. It had a stain on but they cleaned it for free, I just had to pay for the alterations which I knew would be the case when I bought it. The store should really clean and alter your dress for free as they've messed you about.

Oh ok I've just re-read it and worked out what you meant. Either they ordered your dress wrong or the other bride has been given your dress. I only paid half price for my dress because it was a sample. I actually didn't mind that others had tried it on, because the shop made sure that it's condition was as new. You shouldn't be charged full price though, and as I say the work should be done for free.

Definitely name and shame if they dont give you a full refund or a better outcome, how can they work for a bridal shop and be so mean to someone for their big day. its not like its a dress for a night out where you can go get another, its a mde to order dress!

Hello all - thank you so much for your support. Week this evening at 7.30 the owner sent me an official letter via email. The letter basically layer out the chain of events, but omitted within the letter key facts about how she chose the size of the dress to order etc. It was basically said it was my responsibility to ensure she ordered the correct size dress.
The letter stated facts about my visit last Friday which were untrue also.
It included the disclaimer i signed also, which I presume all you brides will have signed when buying new, which states no refunds etc... Which if not signed they will not order the dress. The disclaimer did not state any of my measurements or the dress size that was ordered.. I have no paperwork from the bridal shop confirming this.
Her final offer to me is to give me either the dirty dress, or my dress which is too small, and the offer of the veil.
I would add that when she spoke with my mum on Saturday she finally offered to have the alterations done at her cost, which she ha since gone back on. My mum rejected this offer because by that stage last week we were so upset I no longer wanted the dress.
She indicated I had taken it upon myself to try on other dresses in the shop lay Friday despite the girl in the shop telling me not to. It was the girl who suggested that perhaps I could have another dress off the rack, although she couldn't authorise this and it would have to be agreed with the owner.
The letter is wired that she has sought legal advice and has no obligation to help me at all, and we can only communicate in writing.
The fact I had emailed her when this first happened stating we had no way of proving or disproving what she claimed to be the cause of the problem and we would have to leave it as it was she is also holding against us.
We are basically left with no option but to have the smaller dress and now try and sell it as I cannot wear it now.
I'm beyond gutted, upset and cross. I cannot even leave negative feedback on FB for the worry of being suied doe slander x

Oh this is awful!! I'd still try to take them to small claims, for breach of contract, leave that negative review - it's not illegal to do so, just mention your dress was ordered wrong and other people tried it on without your consent! (the dress is no longer new, if it's been tried on?!) also threaten to go to the press with it, nasty piece of work knows it's her mistake. If you have signed a contract for a new dress and now other brides have tried yours on it is no longer new and surely SHE has breached the contract there? They can't just let other people try it on?

This is sad but what I expected- send her an email saying how disappointed you are with the outcome, yiu do not feel that her email highlights the key facts and true evens and quote my wording re the consumer act, especially the part about the made to measur- put in yiur email that yiu find it odd the the first dress they gave you was a little big but then you were told this was not your dress and you believe that this was yiur dress and they need to prove it

Also ask to see the proper paperwork that was sent for the made to measure dress.

I know this is stressful for you but you need to keep pushing, indontvrealli think she has a comeback on the consumer act either

    Hope this helps

As you can tell I am not one of these people to get worried about legal letters- last week I got a £125 refund from my mibile provider for complaining

Keep fighting- we are all herd to support you xx

I agree with MichelleC..... They must have had paperwork/ordering evidence for the dress size to be ordered... A good bridal will not have not written your measurements down which will provide sufficient evidence that they ordered wrong.

I agree with Velcro about the negative review. It's there for a reason!! It's not slander.

    Don't give up!

    Dear Mrs cow bag,

Further to your email dated xxx, unfortunately this is not a true reflection of the situation and therefore at present the is no resolution, I hope that we can work through my points in order to come to a material agreement quickly, as yiu are aware, my wedding is on xxx date.

When I visited the shop in xxx to try on my dress, my dress that I given to try on was too big, I was then told that this was not the cord t dress. Please can you clarify how this happened as I believe the first dress I was given was in fact my dress and if this is true we would not be in this situation as yiu could have just altered my dress

If you are insisting that there was a mix up and the smaller dress was mine, I woukd question this as to how when this is a made to order dress that yiu ordered for me. I therefore request to view the exact paperwork and measurements that went to your suppliers

With regards to the dress I have paid for I paid for a new made to measure dress- as you kindly let other drives try on my dress without my consent, I therefore feel that this dress is not the condition I ordered and now not a new dress

Furthermore under the consumer act as I ordered a made to measure dress and this does not fit through no fault of my own I am able to either claim my money back or receive a replacement dress in the same condition as my original one- therefore I do not see an off the rack dirty dress as a suitable alternative and request a refund or a new dress

Under the consumer act I am reiterating that I have rejected this dress and request a refund

I very much look forwards to hearing from you

Chop and change as you feel fit to put in the additional, facts but it is a starter for you xx

Thank you - I can honestly say I have never been treated so bad I the guilt I feel for my parents is unbelievable. I havnt slept all night worrying about the matter. The owner has ruined the entire wedding experience, my holiday and has also effectively blamed me for the entire issue.
I'm now doubting everything and wish I knew someone with legal experience and I cannot afford to spend more money on the matter.
I cannot put into words how my mum and I have been made to feel.

    Good post Michelle.

Dont let her get away with it!!! She will have paperwork of what size dress she ordered, or how are the designer suppose to know what size dress to send, and she would have received a reciept from then with the size on.

She is fobbing you off, she can tell that your nice people and is now trying scare tactics to make you accept her offer. Dont. Reply back with Michelles email, and put that you are going to take her to a small claims court and go to the papers. The amount of money and customer she will lose from making your story public is much more than her refunding your dress cost!!

    Shes a nasty woman :(

    Hi Katharine,
I'm so sorry to hear about what has happened to you and the treatment you have received at the hands of this bridal store. I really don't think you should agree with what she has said at all. You have paid her for her service and for a dress which should be yours and yours alone and she hasn't provided that service. I would go to the local papers as then it will put more pressure on her to do the right thing which she clearly isn't doing right now.

Katharine, I would still go ahead with citizens advice. They can offer free legal advice and point you in the right direction.

Failing that there are cheaper outlets such as w3d2b where off the rack dresses cost a fraction of the price....
also attack her where it hurts- social media. Find the f@c3b00k page and leave a review explaining the entire situation and share it.

I'm not sure if wedding insurance would cover a dress?

Hello ladies - at the moment we have no dress at all, she is in possession of the dress which was supposed to be mine but is too small. She claims to have sought advice from a solicitor at the federation for small businesses. I don't know if this is to try and scare us or what.
Our plan right now is to respond to her stating we do not accept her final offer, but as she is in possession of our goods we want these sent to me via courier ASAP.
I could not bear the idea of having to collect the dress.
Once we are back from our holiday, we then intend to put together a better reply detailing why we don't accept her offer.
She has basically put in her letter a ton of lies, made accusations which are not true also.
I cannot believe there are people out there so mean.

Katherine do not ask for the dress, as soon as you do that you have as good as lost your case as you are accepting the product and effectively it is a contact, you paid for the good, she gives then to you, you accept!

You are not accepting these good as they are not fit for purpose, therefore you need to reject the dress and push for a refund or a dress another new dress

Hope, you enjoy the rest of your holiday xx

Sorry just a thought, did your mum pay on credit card?

If so Under Section 75 of the consumer credit act your credit card company is jointly liable for any breach of contract by the company. Get your mum to Contact her Cr edit card company xx

I do agree with the ladies above..... I would also demand and I mean demand that you see your order form!!

If they have ordered wrong, it's their fault obviously and if they ordered the right size but have given your dress to someone else, their fault too.... You have a good case here!! Get that order form. They must of submitted your sizes somehow in writing!
