    I went for a job interview on Monday and was given a job offer. I was asked to confirm by email that I accepted the job offer, which I did. The lady said she will post out the contract, which I have not received (and therefore not signed).

    In the meantime, my boss has offered me better money and I now want to decline the original offer. I am concerned that I might be in breach of contract, or that she might sue me. If someone can categorically advise me either way.

    I have no legal advice but didn't want to read and run, from my experience though I was offered a job but then had the offer taken back when I was unable to make the first meeting ( due to daughter having hand foot n mouth) as long as u haven't started then I think u have every right to turn the job down. As you haven't technically started the employment I don't think ur obliged to stay with them. Especially if you haven't got contract. When are u meant to start the new job? Maybe speak to hr at ur job now x

    You haven't signed a contract with them so I don't think legally they can do anything. I don't have experience in this so like MrsC2bee suggests, speak with HR and perhaps email them back to say something like 'due to unforeseen circumstances I no longer wish to take up the offer of this new position' I don't think they can sue you or anything like that.

    If you have not signed a contract then you have no legal bindings to one so have not breached one.

    Like the ladies have said, you haven't signed a contract or technically started with the new company yet so you have every right to turn down the job offer. I'm sure this happens all the time xx

    Even if you had signed a contract, it usually has a start date of your employment on it at which point the terms of the contract will begin (when your employment begins). That's how mine is anyway. And even if you had started, you can still quit so it really won't be an issue.

    I would go with what Emmilou says and tell them due to unforeseen circumstances you are not longer able to accept the position, and apologise for any inconvenience this may have caused. You don't want to burn any bridges :) xx

    As you haven't signed the contract then I wouldn't worry about it. just be polite when you tell them and don't give any reasons as to why you don't want it any more

    My step dad had accepted a job and was due to start there on a Monday,. On his last day at his old employers theh realised they'd be stuck without him so offered him a really big pay rise so he stayed with his current employer- I'm sure he's signed contracts but they didn't take any legal action.

    If I'm honest even If they could take legal action the cost of doing it would far outweigh any gain on their behalf

    just send an email saying thankyou for the offer of the job but you have since been offered something which suits you better .. job done

    It happens all the time. I got offered a job accepted it and then rang and politely declined the following week. hope youv got it all sorted x

    I phoned the lady up, she was really nice and said that if I changed my mind, then she'd be more than happy to have me!

    My problem is I over think things and got myself in such a state. No matter how hard my oh tried to convince me it was ok, I was still thinking that she could sue me or something! Looking back at how I was last night, I feel incredibly stupid!!

    I did just this twelve years ago ....id had an interview of a job in a school .... Got the call to say I'd got it , then was asked to go to a school closer to where I lived and got offered job there to .... I waited for contract to come from the first so I could look it over but in the mean time considered pros & cons of both places .... Eventually I called the first place and just said what I suggested you emailed. Yep they might have been a bit ticked off but tbh tough ... I had to go with what was right for me .
